Introduction

These Terms and Conditions ("Terms") govern your relationship with Same Day Garage Door, LLC ("we," "us," or "our") and your use of our garage door repair, installation, and maintenance services in Lima, Ohio and surrounding areas. By using our services, you agree to be bound by these Terms.

Service Descriptions

We provide garage door repair, installation, maintenance, and related services in Lima, Ohio and surrounding areas. Our services include but are not limited to:

• Garage door installation and replacement
• Garage door repair and maintenance
• Garage door opener installation, repair, and maintenance
• Spring, cable, roller, and track repair and replacement
• Emergency garage door services
• Preventative maintenance programs

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice. We may also impose limits on certain features or restrict your access to parts or all of our services without notice or liability.

Appointments and Scheduling

We strive to provide service appointments at times that are convenient for our customers. We offer same-day service and emergency repair services when available.

While we make every effort to arrive at scheduled appointment times, circumstances beyond our control (weather conditions, traffic, previous appointments running long, etc.) may result in delays. We will make reasonable efforts to contact you if we anticipate a delay.

If you need to reschedule or cancel an appointment, we request at least 24 hours' notice. Failure to provide adequate notice for cancellations may result in a service fee.

Pricing and Payment

Our prices for services are as quoted by our technicians or as listed on our website. Prices are subject to change without notice.

We provide estimates for all services before work begins. However, additional issues or complications discovered during service may result in additional charges. We will inform you of any additional charges before proceeding with additional work.

Payment is due upon completion of services unless other arrangements have been made. We accept various forms of payment, including cash, credit/debit cards, and checks.

If you dispute a charge, you must contact us within 14 days of the charge date. We will work with you to resolve the dispute in a timely manner.

Service Warranties

We provide warranties on our services and on many parts and products. The specific warranty terms vary by service and product and will be provided to you at the time of service.

Our service warranties typically cover workmanship for a specified period. Manufacturer warranties may cover parts and equipment for different periods.

Warranty coverage may be void if:

• The garage door or system has been modified or repaired by anyone other than our technicians

• Damage is caused by accidents, acts of God, or other factors beyond our control
• The door is used for commercial purposes when it was installed for residential use

To make a warranty claim, please contact us directly. We will assess the issue and determine if it is covered under warranty.

Customer Responsibilities

As our customer, you are responsible for:

• Providing accurate information about your garage door and issues you are experiencing
• Ensuring we have safe access to your garage and the door system
• Keeping children and pets away from the work area during service
• Following our recommendations for maintenance and safe operation
• Making timely payments for services provided
• Notifying us promptly of any issues following our service

Limitation of Liability

To the fullest extent permitted by law, Same Day Garage Door, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use our services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from our services
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services

Our liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid us for the applicable service.

Indemnification

You agree to defend, indemnify, and hold harmless Same Day Garage Door, LLC, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of our services, or your violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in Allen County, Ohio.
